Commission Order/Opinion

This is an order issued by the Commission, under the Commission seal as attested by the signature of the Secretary of the Commission, in direct exercise of the authority of the Commissioners.

A Numbered Order is an order, revision or supplement to a numbered order in a rulemaking docket, as culmination of a rulemaking process on a subject as initially defined in the Notice of Proposed Rulemaking (NOPR) that originated a specific rulemaking procedure.  Rulemaking orders are numbered sequentially (RM docket prefix.)   A Numbered Opinion is a final order in a docketed proceeding, which has been determined to have important policy implications and which is intended to have effect as a controlling precedent (compliance implications for other regulated utilities as well as the parties to the proceeding).  Opinions are numbered sequentially.

Delegated Order

This is any order issued by a FERC office in the exercise of authority delegated by the Commission.  A delegated order may be defined by the purpose of the order as accepted, accepted or granted, dismissal, dismissal without prejudice, denied, granted, granted in part and denied in part, hearing, rejected, rejected or denied, settled, self-implementing and withdrawn.  An order may serve to determine a procedural matter in litigation.  An order also may rule on a jurisdictional issue.

Dissent/Concurrence by the Commissioner

This is an opinion on the part of one or more Commissioners who decline to join in the majority opinion expressed in an order by the Commission.  A dissent/concurrence may be in whole or in part.  A dissent/concurrence may be attached to the order or may be submitted separately, at the time of the order or at a later date.

Interpretation and Advisory Opinion

This is a document prepared and issued by the Chief Accountant, the General Counsel or a technical office director in response to a formal request by a utility or other party for an interpretation or advisory opinion as guidance on a subject, such as the acceptability of accounting procedures or activities by a utility where the scope of FERC jurisdiction is uncertain.  A formal interpretation is advisory and not legally binding on the Commission.
