Deposition Document Definitions

Deposition

This is a transcribed record of questions addressed orally by counsel for one party in litigation to an adverse party and the responses to those questions.  Depositions are made under oath. 

Notice/Motion to Depose

This is a pleading addressed to the presiding ALJ or the Commission by a party to a proceeding before FERC, requesting the issuance for an order authorizing the requesting party to take the deposition of an adverse party.  In some instances, the party taking a deposition submits a formal notice of deposition, identifying individual, affiliation and records that are the subject of the deposition, as well as date, time, and place of the deposition.

Objection to Deposition

This is a pleading submitted by the person to be deposed, or by counsel or other agent, in response to a motion or notice of deposition, stating the basis for an objection to the taking of a deposition or seeking to limit its scope.
