Rulemaking Comment

These documents submitted by any party in response to a Notice Of Proposed Rulemaking (NOPR) issued by the Commission, providing analysis and recommendations with respect to the proposed rulemaking.  The NOPR itself is typically a comprehensive document, describing the reasons or basis for initiating the proposed change or innovation in FERC policy, explaining the purpose or goals of the rulemaking, examining alternatives and options, and laying out the methods or planning of implementation.  A rulemaking comment, in response, varies from terse opinion about one or more aspects of the rulemaking to a thorough and detailed critique of the entire NOPR and even to the submittal of alternative proposals, extensive plans for implementation, and other documentation.  (RM docket prefix.)

Settlement Comment

This is a document prepared by any party to a proceeding before the Commission, including intervenors, which sets forth the views or position of the submitting party on a proposed agreement or settlement to resolve any or all of the issues in dispute in the proceeding.  Settlement comment may include supporting arguments, it may approve of the settlement partially and oppose it in part, and it may address all provisions of the proposed agreement or be restricted to remarks concerning only some terms of the proposal.  It is customary for the party or parties submitting the settlement to augment the proposal with supporting comment, usually as an explanatory statement.

Litigation Comment

This is a document prepared by an intervenor or other party to a proceeding in litigation before an ALJ or the Commission which expresses the views and states the position of the submitting party on issues or matters in dispute in the proceeding.  Litigation comment frequently recommends particular Commission action, or urges expedited disposition of the matter, or conversely, argues that resolution of the proceeding be delayed.

This is a document prepared in response to a FERC public notice, which requests all interested parties to submit written comments and protests by the specified due date.
